Buying terms:

Introduction

This section constitutes a binding agreement between the User (hereafter within these Buying Terms "Buyer") and All Day Pretty. All Day Pretty is in no way associated with the brands that it sells.

 

Buyer wishes to purchase certain items ("Item") as may be displayed and described on our Website/App. It is All Day Pretty's sole discretion to display or remove the displayed item depending on its availability or non-availability. All Day Pretty is not liable to inform or alert the Buyer before removing or adding such an item. All Day Pretty wishes to sell the Item on behalf of a seller, subject to Buyer agreeing the following Buying terms and Terms of Service:

 

Authenticity

All Day Pretty assures product authenticity and authenticity certificate on demand, for any item of interest. You can contact us on hello@alldaypretty.com

 

2.     As a courtesy to the Buyer, All Day Pretty may or may not provide descriptions and condition description of the Item on site and through other direct or indirect, online or offline means of communications. Buyer should note that descriptions of Item are not warranties and that each Item is sold 'as is'.

3.     Buyer cancelling an instalment order has to contact All Day Pretty via email at hello@alldaypretty.com informing the wish to do so.

4.     The methods of payment for a purchased Item as accepted by All Day Pretty are communicated via Site. Usually includes:

·        PayPal

·        Apple Pay

·        Tabby

·        Shop pay

·        Amazon pay

·        G pay

Product Descriptions

All Day Pretty attempts to be as accurate as possible. However, All Day Pretty does not warrant that product descriptions, titles, attributes, specifications, price or other content or any other information related to the product(s) are accurate, complete, reliable, current, or error-free.

All Day Pretty holds ownership in the way the titles or content are laid out, arranged and standardised.

·        Estimated Retail Price:

·        The "estimated retail price" is an estimate/guess/judgment based on research from the brand's main site or other competitive sites. The buyer agrees that All day Pretty, in its sole discretion, will determine the initial estimated selling price for the item (the "Estimated Retail Price"), based on its evaluation of the item together with its determination of the current market price.

·         

·        All Day Pretty Price:

·        "All Day Pretty Price" means the decided selling price of a product which is a result/consequence of a binding agreement between the seller and All Day Pretty. We regularly check estimated retail prices against prices recently found on All Day Pretty and other retailers. Certain products may have a "Was Price" displayed when the item goes on sale, which is determined using the recent price history of the product on All Day Pretty Website.

 

·        With respect to items on sale on All Day Pretty, we cannot warrant the price of an item until your order is confirmed by us. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If the correct price of an item sold is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation and the refund thereof. All Day Pretty is not liable to contact the customer for any item that is priced incorrectly.


Import & Admin Charges

All Day Pretty items are shipped from Europe, UK & US warehouses. Almost all countries apply Customs duty on import of items. Hence, all international deliveries from All Day Pretty are subject to import and admin charges which are collected as follows:

 

Import and admin charges are not included in the item price and are to be paid by the buyer at the time of delivery.

Buyers are liable to check duty rates for their own country. We suggest that you seek Internet Assistance to get an estimate of the applicable Customs Duties & Taxes in your country.

 

Customs duty on orders placed via credit card (CC), PayPal, Apple Pay, Amazon pay, Shop pay and Tabby are collected by the courier partner directly at the time of Customs clearance.

 

License and Site Access

All Day Pretty provides you with a limited license to access and use the Site and the Service for personal purposes. This license does not permit:

  • Downloading or copying account information for the benefit of other vendors or third parties.
  • Caching, creating unauthorized hyperlinks to the Site, or framing any Content available on the Site.
  • Uploading, posting, or transmitting any content that you do not have the rights to share (including intellectual property owned by others).
  • Uploading, posting, or transmitting materials that contain software viruses or any other computer code, files, or programs intended to disrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
  • Any action that may impose an unreasonable or disproportionately large burden on All Day Pretty’s infrastructure, as determined solely by All Day Pretty.
  • Using data mining, robots, or similar tools for data gathering and extraction.

You may not circumvent any measures put in place by All Day Pretty to prevent or limit access to the Site. Any unauthorized use will result in the termination of the permission or license granted to you by All Day Pretty.

Proprietary Rights

  1. Trademarks: The "Marks" displayed on this Site are the property of All Day Pretty and other parties. Users are strictly prohibited from using these Marks for any purpose (including metatags) without prior written permission.

  2. Copyrighted Content: All Site "Content" (including text and software) is protected by copyright. You may not modify, transmit, or sell any Content for public or commercial purposes.

  3. Third-Party Brands: All Day Pretty is not affiliated with, or an authorized representative of, the brands sold on this Site. All trademarks belong to their respective owners.

 Disclaimer of Warranty

All content, products, and services available on the Site, or obtained from any linked website (a "linked site"), are provided to you "as is" without any warranties, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, or accuracy.

All Day pretty does not endorse, nor is it responsible for:

  • (a) The accuracy or reliability of any opinions, advice, or statements made on the Site by parties other than All Day Pretty.
  • (b) Any content provided on linked sites.
  • (c) The capabilities or reliability of any products or services obtained from linked sites.
  • (d) Any technical or human errors arising from software issues, technology failures, bugs, malware, virus attacks, hacking, or other unforeseen circumstances that may lead to inaccuracies in content, pricing (including All Day Pretty's pricing), original retail prices, descriptions, etc.

Except as required by applicable consumer protection laws, All Day pretty will not be liable for any loss or damage resulting from a user's reliance on information obtained from the Site or a linked site, or from any products or services acquired through a linked site. It is the user's responsibility to assess the accuracy, completeness, or usefulness of any opinions, advice, or other content available on the Site or obtained from a linked site. Please consult with professionals as necessary for evaluating specific opinions, advice, products, services, or other content.

All promotional dates refer to the current year, unless stated otherwise.

 Modifications and Notifications

All Day Pretty reserves the right to update this Site and our policies at any time. For material changes, we provide 30 days' notice via account emails and prominent announcements on the relevant policy pages. We are not responsible if your email provider filters our notifications, so please ensure our domain is approved in your inbox.

Once the 30-day notice period ends, we will archive a brief description of the change in our "Historical Modifications" section. It is your responsibility to review this section if you have been inactive for more than 30 days. Continuing to use the Site after changes take effect constitutes your acceptance of the new Terms. Limitation of Liability

You acknowledge and agree that All Day Pretty, along with its subsidiaries, affiliates, officers, employees, agents, partners, and licensors, will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, inaccuracies in pricing caused by human error, technical issues, software bugs, or other problems, as well as damages related to loss of profits, goodwill, use, data, or other intangible losses—even if All Day Pretty has been informed of the potential for such damages—arising from your use of the Site, its content, or any associated services.

Furthermore, All Day Pretty is not responsible for the privacy practices, use of cookies, pixels, or any other tracking technologies employed by third-party services integrated with our website.

 Indemnity

You agree to indemnify and hold harmless All Day Pretty (along with its officers, directors, agents, subsidiaries, joint ventures, and employees) from any claims or demands, including reasonable attorneys' fees, that arise from or relate to your breach of these Terms of Service or your violation of any laws or the rights of a third party.

Any disputes or claims related to this website will be governed by and interpreted in accordance with the laws of the UAE. The United Arab Emirates is our country of domicile.

Intellectual Property Rights & Infringement Policy

At All Day Pretty, we value creativity and respect the intellectual property of others. We expect our community to do the same. We reserve the right to disable or close accounts belonging to users who infringe on these rights.

Which Terms Still Apply After Termination?

Even if this agreement ends or expires, any sections that by their nature are meant to continue—such as those regarding your ongoing obligations or legal responsibilities—will remain in full effect.
